MINUTES OF GMCA ADVISORY BOARD MEETING

MARCH 15, 2007


The meeting was called to order at 11:00 a.m. by President Pio Ieraci.

Board Members present: Ieraci, Berkowitz, Glickfield, Gill, Guttman, Hamaker, Songer, McBride, Bindler, Casier, Comis, Creal, Drews, Freismuth, Gilligan, Mayer, Montross, Nicholson-Brown, Weck and Vanek.

Approval of Minutes - The minutes of February 15, 2007 were approved.

Old & New Business

  • President Ieraci announced that a schedule is being put together to line up State Senators, Commissioners, dignitaries, etc. for our meetings.

  • Impact of Spring Break was discussed.

  • Fort Lauderdale City News: Every Association independently determines individual publications and newsletters policy.

  • Ft. Lauderdale Police Department: Galt has new Sergeant

  • Ralph Hamaker reported on Commissioner Teel�s meeting � Major Kiley was instructed to cover Walgreen�s corner (Miles Corner); Martorano�s was informed that they cannot block south lane to street.

  • Pio Ieraci spoke about cell phone communication on the Mile; there is a problem with reception inside of buildings; reason: cell sites are inland and we are on the fringe. A question was raised as to whether the cell sites can be brought closer to us; also, would antennae installation on buildings improve reception.

  • A reorganization is underway that will expand participation. Our objective is to afford every association reliable representation and input. Many years ago, speakers would be brought in to address meetings open to all Galt residents. It was suggested we have meetings every couple of months and invite everyone on the Mile to attend. It would be preferable to hold these meetings during the �season�..

  • Would like 2 members appointed by each building to attend Advisory Council; every association would nominate representatives and have them attend meetings.

  • Any changes to list of building information should be sent to Eric Berkowitz with a copy to Pio Ieraci.

Il Lugano � Ralph Hamaker - Construction is proceeding at a snail�s pace; possible due to rumored financial problems. Discussed construction and blocking of streets.

Center Strip Update - Some improvements have been made; leasing rates have been substantially increased; Wings is moving to the old Mack�s Grove location at Commercial and A1A; the gas station at corner of A1A and Commercial has been sold and Commerce I Bank will build on that location; Gumwrappers is now the Dive Bar.

Kevin Songer spoke about speeding along A1A.

Ralph Hamaker confirmed that while the trees along the west side of A1A were provided by the City, the buildings are responsible for their maintenance.

Eric will contact Rabbis regarding purchasing properties.

Denny�s - On hold � Boutique hotel plans have been pulled.

Beach Renourishment - County Commissioner Ken Keechl has expressed interest in this project; we should see some activity in 2008.

Legislative Update � Eric Berkowitz -

  • SB 314 sponsored by Sen. Geller is the condominium termination bill which is very likely to pass as it has the strong support of the Real Property Section of the Florida Bar and is one of their highest priorities.
  • HB 433 sponsored by Rep. Carl Domino contains language which would make it easier to amend condominium documents that are currently burdened with lender consent requirements.
  • SB 396 sponsored by Sen. Margolis is a Condominium Conversion bill which deals with certain converter reserves and insurance fixes. This bill would require additional disclosures in contracts for the sale or lease of residential units and clarifies that the definition of condominium common expenses includes the costs of certain insurance or self insurance. The bill also requires notice for special assessments for self insurance purposes. This bill contains incremental �insurance fixes� that attempt to make commercial self-insurance funds more attainable.
  • SB 348 sponsored by Sen. Mandy Dawson would prohibit associations from requiring a prospective buyer of a property to present evidence of any financial status or to make a monetary deposit to the association so long as such prospective buyer has been approved by a lending institution to obtain the financing that is necessary to purchase the property.
  • SB 714 sponsored by Sen. Gary Siplin�s would prohibit associations from liening/foreclosing and/or pursuing a monetary judgment for amounts less than $2,500 and would remove the association's ability to recoup attorney's fees and costs.
  • SB 1844 sponsored by Sen. Ring would require attorneys handling collection matters for association clients to accept a 90-day payment plan for their attorney's fees when pursuing a delinquent owner.
  • HB 1317 sponsored by Rep. Robaina experienced a strike-all and is being amended. The changes aren't yet available for scrutiny.
  • HB 1365 sponsored by Rep. Gibbons contains emergency powers language to assist boards dealing with community preparations pre-storm as well as dealing with post-storm reconstruction issues Currently, this bill is not moving and needs your help if it is to be amended on to a moving community association bill.

Eric recommended that there should be an individual in each building (preferably not a Board Member) to review and deliver legislative information to owners.

Galt Roving Security Patrol - Lauderdale Beach Homeowner�s Association is becoming impatient due to the length of time it has taken us to finalize our commitment to this project. Pio will contact Marty Glazer (South Point).

Treasurer�s Report - Leah Glickfield reported $15,976.07 in our Treasury.

Next Advisory Board Meeting - The next regular Advisory Board Meeting will be held on Thursday, April 19, 2007 at Nick�s Italian Restaurant.

The meeting was adjourned at 12:40 p.m.
